WHAT IS PRE-TRIAL INTERVENTION?

Pre-Trial Intervention (PTI) in South Carolina is a program that resolves your criminal charge. Upon successful completion, your charge is dismissed and is expunged off of your record.

Pre-Trial intervention is up to the prosecutor. There is no automatic right to enrollment or the program. The prosecutor must refer your case to PTI. There are certain charges, such as DUI, which cannot be sent to pre-trial intervention. Furthermore if the officer or victim objects, the prosecutor may decide not to send you to PTI.

WHAT DOES PTI INVOLVE?

The application fee is $100. You pay another $250 when you complete of the program. Pre-Trial Intervention will interview you and your counselor sets a plan. You must complete random drug and alcohol tests. You must also complete community service.

Upon completion, you pay $285 to expunge the charge of of your NCIC. Expungement is not required, but if you don’t the arrest remains on your FBI background check.
